What are the California DUI Laws?

Anyone granted the driving privilege consented to law enforcement to conduct chemical testing of the motorist’s blood or breath. Driving a vehicle under the influence of alcohol or drugs violates the law, as is anyone driving with a blood alcohol reading of 0.08% or higher.

However, in the case of a Truckers’ DUI, it is illegal for a driver to operate a commercial vehicle with a blood alcohol reading of 0.04% or higher. (A reading of 0.01% or higher will put the driver out of service.)

Underage DUI and Zero Tolerance:

A driver under 21 years of age with a blood alcohol reading of 0.01% or higher on a Preliminary Alcohol Screening (PAS) device may have their license revoked or suspended.

License Suspension or Revocation: A driver under 21 with a blood alcohol reading of 0.05% or higher is subject to arrest and license suspension or revocation.

Drinking alcohol affects your Blood Alcohol Concentration (BAC)

It is illegal to drive with a BAC that is .08% or more (.04% or more if you drive commercial vehicles; .01% or more if under 21). However, a BAC below .08% does not mean driving is safe or legal. The charts below show the BAC zones for various numbers of drinks and periods.

Remember: “One drink” is one ½-ounce shot of 80-proof liquor (even if mixed with non-alcoholic drinks), a 5-ounce glass of 12% wine, or a 12-ounce glass of 5% beer. These “one drink” equivalents change depending on the alcohol consumed. This difference lies in the varying alcohol content of ales, malt liquors, fortified wines, ports, brandies, and different proof liquors. Other factors that contribute to differences in alcohol effects are:

  • Drinking On An Empty Stomach
  • Sleep Deprivation
  • Illness
  • Medications Or Drugs
  • Emotional States
